Booking Contract

Please read the contract below carefully before submitting.

INTRO

Several weeks after your session, depending on what session you chose, you will receive an email from me with a link to your personal gallery. Through your personal gallery you can instantly download your photos and you even have the option to order high-quality prints! If you choose to print yourself, please use a professional lab or printing service. In Knoxville, you can print with F/32 Photo or use a service such as Shutterfly. I would not recommend a 1-hour or retail printers (Walgreens, Walmart, Target, CVS, Costco…) because they print a more low-quality image and will not best represent my photos. At your convenience, please read through the policy below. If you have any questions, please email me and I'll be happy to go through it and answer your questions. When you're ready, just fill out the required information below and then press “SIGN”.

SECTION 1

E-Signature/Payment/Reservation

An agreement of session details via email, a digital signature on this form, and the retainer or the full session fee are required to reserve the time and date agreed upon, and ensures that the Photographer will make no other reservations for that time.

SECTION 2

Client Cancellation Policy

For this reason, the session retainer fee is non-refundable, even if the date is changed or canceled for any reason. In the instance of cancellation, the deposit will be applied to any future service, booked within 30 days of the original contract date. This deposit will be lost after 30 days, if the Client has not made arrangements for a new session. It will also be the responsibility of the Client to stay in contact with the Photographer to make such arrangements. Due to scheduling, the Photographer will propose several possible alternative session dates. If a suitable rescheduling cannot be reached, at the Photographer’s discretion, the session can be scheduled further than 30 days in advance. Only 2 reschedules are permitted before Client is at risk of losing Session Retainer for Noncompliance.

SECTION 3

Client Cancellation Policy Cont.

If you cancel or reschedule within 24 hours of your session, a retainer will need to be paid to book another session. If inclement weather requires rescheduling, no penalty will be applied to Client.

SECTION 4

Photographer Cancellation Policy

In the unlikely event that the Photographer is injured, becomes too ill to photograph the session, or cannot perform this agreement due to fire, casualty, nature, or other cause beyond the control of all parties, the Photographer will make every effort to secure a rescheduling of session. (If the Photographer reschedules within 48 hours, Client will receive their retainer amount credit - Unless reschedule is due to weather, at Photographer's discretion.)

SECTION 5

Photograph liability

In the Midst takes the utmost care with respect to exposure, transportation, and storage of photographs. However, in the unlikely event that the photographs have been lost, stolen, or destroyed for reasons within or beyond Photographer’s control, we will first make every attempt to recover the images if possible, or schedule a re-take of the session. The limit of liability for a partial loss of the originals shall be a prorated on the amount of the images lost based on the percentage of total number of photos to be delivered to client, if rescheduling to complete the amount of images promised is not possible.

SECTION 6

Additional Photo Touch Up Fee

Every photo you receive is a direct reflection of In the Midst Photography so each image you receive will be professionally retouched and enhanced in the best way possible, as decided by Photographer. The Photographer will edit any blemishes, blur backgrounds, remove distracting elements from the photos, etc. If you request additional editing beyond the standard editing process/time spent – there will be a charge of $5-10 per photo, at Photographer’s discretion. This will be discussed with you and confirmed before invoicing for additional editing costs.

SECTION 7

Client Tardiness/Communication

The Client shall assist and cooperate with the Photographer in obtaining the desired photographs. The Photographer shall not be responsible for photographs not taken, or the outcome of photographs as a result of the Client’s failure to provide reasonable assistance, communication, or punctuality. Any tardiness will result in shortened session time. Tardiness of more than 20 minutes to this session without communication with Photographer will be considered a cancellation. See #2 for cancellation policy. Please also understand that due to the short session time, if any little ones are not happy or uncooperative, it may result in a lower number of images. If you decide to reschedule, please refer to #3 for any fee applicable.

SECTION 8

Photo Return Time

The Client will receive a link to view and download the high-resolution images with unlimited personal Print/Usage Release within the amount of time of the chosen session (ex.mini session 2-4 weeks, general session 3-6 weeks).

SECTION 9

Photographer Image Copyright

The Photographer retains copyright in the photographs, and hereby grants the Client unlimited but non-exclusive rights to use or reproduce the photographs for which the Client has paid. Use of photos for advertising purposes by the Photographer is acceptable, unless otherwise noted below in the comments section of your signature form.

SECTION 10

No Client Editing/Social Media Tag

Digital images purchased are the property of the Client for personal use only. However, Copyright Law dictates that Photographer’s work may not be altered, re-edited or changed in any way by Client. (This includes editing the image any way, cropping more than simply printing, or applying any filters on social media such as Facebook or Instagram.) Photographer also requests that any photos published online, be noted/ tagged with In the Midst Photography as the Photographer. My social media tags are as follows: Instagram is @inthemidst.photo and Facebook is @in the midst photography (please insert spaces between words for the Facebook tag).
